Policies & Guidelines

3.1 Account Creation: To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. By creating an account, you represent and warrant that you meet this age requirement.

3.4 Account Termination: We reserve the right to suspend or terminate your account at any time, with or without cause or notice, for any reason including, but not limited to, violation of these Terms.

4.1 Creator Status: To become a Creator on Khingo, you must complete the creator onboarding process, which includes accepting these Terms and our Content Guidelines.

4.2 Content License: By uploading content to the Platform, you grant Khingo a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the Platform and Khingo's business, including for promotion and redistribution of part or all of the Platform in any media formats and through any media channels.

4.3 Content Ownership: You retain all ownership rights in your content. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to grant the license described above.

4.4 Content Responsibility: You are solely responsible for your content and the consequences of posting or publishing it. You agree that you will not post content that violates any law, infringes on the rights of others, or violates these Terms or our Content Guidelines.

5.1 Platform Content: All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of Khingo or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

5.2 Copyright Infringement: We respect the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please contact us with the following information:

• A description of the copyrighted work that you claim has been infringed
• The location on the Platform where the allegedly infringing material is located
• Your contact information
• A statement that you have a good faith belief that the use is not authorized
• A statement that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

6.1 Revenue Model: Creators earn revenue through our pay-per-view (PPV) system. Revenue is calculated based on actual views and engagement metrics as determined by our analytics system.

6.2 Payment Terms: Payments to creators are processed according to the payout schedule selected during onboarding (monthly or twice-monthly). A minimum payout threshold of 100 tokens applies. Early withdrawals are subject to a 5% processing fee.

6.3 Payment Methods: We support various payment methods including bank transfer, PayPal, Stripe, and M-Pesa. You are responsible for providing accurate payment information and keeping it updated.

6.4 Taxes: You are solely responsible for determining and paying any applicable taxes on your earnings from the Platform. We may be required to collect tax information and report earnings to tax authorities as required by law.

6.5 Payment Disputes: If you have a dispute regarding payments, you must notify us within 30 days of the payment date. We will investigate and resolve disputes in good faith.

8.1 Moderation Rights: We reserve the right to review, moderate, remove, or disable access to any content on the Platform at any time, for any reason, including but not limited to violation of these Terms or our Content Guidelines.

8.2 Enforcement Actions: Violations of these Terms may result in warnings, content removal, temporary suspension, or permanent termination of your account. We may also take legal action if necessary.

8.3 Appeals: If you believe your content was removed or your account was suspended in error, you may appeal by contacting our support team. We will review appeals in good faith but are not obligated to reverse our decisions.

9.1 Termination by You: You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

9.2 Termination by Us: We may suspend or terminate your account immediately, without prior notice, for any violation of these Terms or for any other reason we deem necessary to protect the Platform and its users.

9.3 Effect of Termination: Upon termination, your right to use the Platform will immediately cease. We may delete your account and content, though we may retain certain information as required by law or for legitimate business purposes.

9.4 Outstanding Payments: Upon termination, we will process any outstanding payments owed to you according to our payment terms, subject to any deductions for violations or chargebacks.

10.1 Platform "As Is": The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 Limitation of Liability: To the maximum extent permitted by law, Khingo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.

10.3 Maximum Liability: Our total liability to you for all claims arising from or related to the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

12.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

12.2 Dispute Resolution: Any disputes arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of [Arbitration Organization], except where prohibited by law. You waive your right to a jury trial and to participate in a class-action lawsuit.

13.1 Entire Agreement: These Terms, together with our Privacy Policy and Content Guidelines, constitute the entire agreement between you and Khingo regarding the Platform.

13.2 Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13.3 Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

13.4 Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
